Welcome to Kmstuddioz ("Kmstuddioz," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website [www.kmstudioz.com] (the "Website"), including browsing, creating an account, placing orders, and making payments for Indian dresses and related products ("Products").

By accessing or using the Website, or by placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

1. Definitions

  • "User," "you," "your" refer to any person who accesses or uses the Website.

  • "Products" refers to sarees, salwar suits, lehengas, kurtis, and other Indian dresses and apparel listed for sale on the Website.

  • "Order" means a request placed by a User to purchase Products through the Website.

  • "Payment Gateway" means the third-party payment processing service(s) integrated with the Website to facilitate online payments.

2. Eligibility

To use the Website and place Orders, you must be at least 18 years of age or be using the Website under the supervision of a parent or legal guardian. By using the Website, you represent that you meet this requirement and that all information you provide is accurate and complete.

3. Account Registration

  • You may be required to create an account to place Orders. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.

  • You agree to notify us immediately at [support email] of any unauthorized use of your account.

  • Kmstuddioz reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Products and Pricing

  • All Products displayed on the Website are subject to availability. We make reasonable efforts to display accurate images, colors, fabric details, and measurements; however, slight variations may occur due to handcrafted work, dyeing processes, screen resolution, or lighting.

  • Prices are listed in Indian Rupees (INR) and are inclusive/exclusive of applicable taxes (GST) as indicated on the product page.

  • Kmstuddioz reserves the right to modify prices, discontinue Products, or correct pricing errors at any time without prior notice. If a pricing error is discovered after an Order is placed, we will notify you before processing the Order.

5. Orders

  • Placing an Order constitutes an offer to purchase the selected Product(s). An Order is confirmed only upon successful payment and receipt of a confirmation email/SMS from Kmstuddioz.

  • Kmstuddioz reserves the right to cancel or refuse any Order at its discretion, including in cases of suspected fraud, pricing errors, stock unavailability, or violation of these Terms. In such cases, any amount paid will be refunded to the original payment method.

6. Online Payment

  • Kmstuddioz accepts payments through secure third-party Payment Gateways, including but not limited to credit/debit cards, UPI, net banking, and digital wallets.

  • All payment information (card details, UPI IDs, etc.) is processed directly by the Payment Gateway and is not stored on Kmstuddioz servers. Payment Gateways used are PCI-DSS compliant.

  • Kmstuddioz is not liable for any failure, delay, or error caused by the Payment Gateway, bank, or network provider during a transaction.

  • In case of a failed transaction where funds are debited from your account but the Order is not confirmed, the amount will typically be reversed by your bank/Payment Gateway within [5–7 business days]. Please contact us at [support email] if you do not receive a reversal within this period.

  • Cash on Delivery (COD) Terms:

    • COD orders are subject to an additional charge of ₹100 per article, over and above the listed product price.

    • An advance payment of ₹300 is mandatory to confirm any COD order. This advance must be paid online at the time of placing the Order.

    • The remaining amount (product price + COD charges, less the ₹300 advance already paid) is payable in cash at the time of delivery.

    • If a COD order is cancelled after the advance has been paid, refund of the advance will be governed by the Cancellations, Returns, and Refunds terms in Section 8.

    • If delivery is refused or the remaining amount is not paid at the time of delivery, Kmstuddioz reserves the right to treat the ₹300 advance as non-refundable and/or restrict future COD access for that account.

7. Shipping and Delivery

  • Kmstuddioz ships Products across [India / specify regions] through registered courier partners.

  • Estimated delivery timelines will be provided at checkout or in the Order confirmation; these are estimates and not guaranteed and may be affected by location, courier delays, weather, or other factors beyond our control.

  • Shipping charges, if applicable, will be displayed at checkout.

  • Risk of loss and title for Products pass to you upon delivery to the shipping address provided.

8. Cancellations, Returns, Exchanges, and Refunds

  • Cancellation: Orders may be cancelled by the User within 2 hours of placement, provided the Order has not been shipped. Once shipped, cancellation requests cannot be processed.

  • Exchange Policy

  • Exchange only for manufacturing defects

  • 360° uncut opening video is mandatory

  • The video must start before opening the parcel

  • No video = No exchange

  • Refunds: Approved refunds will be credited to the original payment method within [7–10 business days] of the returned item passing quality inspection. Shipping charges (if any) are typically non-refundable unless the return is due to a defect or error on our part.

  • Damaged/Defective Products: If you receive a damaged, defective, or incorrect Product, please contact us within [48 hours] of delivery with photos/video of the issue for a replacement or refund.

9. Intellectual Property

All content on the Website- including but not limited to logos, designs, images, product photographs, text, and graphics- is the property of Kmstuddioz or its licensors and is protected under applicable intellectual property laws. You may not reproduce, distribute, modify, or use any content from the Website without prior written consent from Kmstuddioz.

10. User Conduct

You agree not to:

  • Use the Website for any unlawful purpose or in violation of these Terms.

  • Attempt to gain unauthorized access to the Website, its servers, or connected databases.

  • Post or transmit any harmful, defamatory, obscene, or infringing content through the Website (e.g., in reviews or comments).

  • Use automated means (bots, scrapers) to access or extract data from the Website without permission.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Kmstuddioz shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Website or Products, including but not limited to delays in delivery, minor variations in product color/fabric, or third-party payment/courier failures. Our total liability for any claim shall not exceed the amount paid by you for the relevant Order.

12. Indemnification

You agree to indemnify and hold harmless Kmstuddioz, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or misuse of the Website.

13. Privacy

Your use of the Website is also governed by our [Privacy Policy], which describes how we collect, use, and protect your personal information, including data shared during account creation and payment processing.

14. Force Majeure

Kmstuddioz shall not be held responsible for any delay or failure in performance resulting from events beyond its reasonable control, including natural disasters, strikes, government restrictions, courier disruptions, or pandemics.
